DALL'AGENZIA DELLE ENTRATE DISPOSIZIONI ATTUATIVE SULL'ADEMPIMENTO COLLABORATIVO


L'Agenzia delle Entrate, con il Provvedimento del 26 maggio 2017, detta le disposizioni attuative dell'adempimento collaborativo al fine di "promuovere e instaurare un rapporto di fiducia tra Amministrazione finanziaria e contribuente, ed aumentare così il livello di certezza sulle questioni fiscali rilevanti". Questo regime innovativo, introdotto nel nostro ordinamento tributario dal Dlgs 128/2015, comporta l'assunzione di impegni sia da parte dell'Agenzia delle Entrate sia da parte dei contribuenti ammessi. Il provvedimento pubblicato, nello specifico, individua: i doveri dell'Agenzia delle Entrate i doveri del contribuente le modalità per lo svolgimento della procedura le cause di esclusione e revoca le competenze per i controlli e le attività relative al regime. Nella prima fase d'applicazione, sono ammessi al regime di adempimento collaborativo esclusivamente: i soggetti residenti e non residenti il cui volume d'affari o ricavi non sia inferiore a dieci miliardi di euro; i soggetti residenti e non residenti con un volume d'affari o ricavi non inferiore a un miliardo di euro, a patto che abbiano presentato istanza di adesione al Progetto Pilota; le imprese che intendono dare esecuzione alla risposta dell'Agenzia fornita a seguito di istanza d'interpello sui nuovi investimenti - Dlgs n. 147/2015, articolo 2 - indipendentemente dal volume d'affari o di ricavi. Relativamente ai requisiti soggettivi, viene estesa la partecipazione al regime anche alle società appartenenti al gruppo del soggetto che ha presentato domanda di ammissione e che svolgono nei confronti di esso funzioni di indirizzo in relazione al sistema di controllo del rischio fiscale. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
