DEFINIZIONE AGEVOLATA DELLE LITI PENDENTI: APPROVATO IL MODELLO. DOMANDE ENTRO IL 30 GIUGNO


Con Provvedimento del 1 febbraio 2023 l'Agenzia Entrate ha approvato il modello di domanda, e relative istruzioni, che i contribuenti che intendono chiudere le controversie ancora aperte con il Fisco dovranno utilizzare al fine di definire in maniera agevolata le controversie tributarie pendenti in cui è parte l’Agenzia. Parliamo, in particolare, delle domande per la definizione agevolata delle controversie tributarie in cui è parte l’Agenzia delle entrate, pendenti al 1° gennaio 2023 in ogni stato e grado del giudizio, compreso quello in Cassazione e anche a seguito di rinvio. Si considerano pendenti, spiegano le Entrate, le liti il cui atto introduttivo del giudizio in primo grado sia stato notificato alla controparte entro il 1° gennaio 2023 e per le quali, alla data di presentazione della domanda, il processo non si sia concluso con pronuncia definitiva. Le domande dovranno essere presentate direttamente dal contribuente o tramite un soggetto incaricato, entro il 30 giugno 2023. In attesa dell’attivazione del servizio specifico per la compilazione e la trasmissione telematica, è possibile presentare la domanda inviandola all’indirizzo Pec dell’Ufficio che è parte nel giudizio. La definizione si perfeziona con la presentazione della domanda e con il versamento dell’importo netto dovuto (o della prima rata) entro il 30 giugno. Non è ammesso il pagamento rateale nel caso in cui gli importi da versare non superino 1.000 euro. Qualora non ci siano importi da versare, la definizione si perfeziona con la sola presentazione della domanda.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
