Scadenza per beni 4.0 prenotati nel 2022: novembre 2023 (materiali) e giugno 2023 (immateriali)


In prossimità della scadenza originariamente prevista per il 30 giugno 2023, ricordiamo che Decreto Milleproroghe, ha prorogato al 30 novembre 2023 il termine “lungo” per effettuare gli investimenti in beni materiali 4.0 prenotati entro il 31 dicembre 2022. Alle imprese che hanno effettuato investimenti in beni strumentali materiali nuovi 4.0 (indicati nell’allegato A alla L. 232/2016), a decorrere dal 1° gennaio 2022 e fino al 31 dicembre 2022, ovvero che li effettueranno entro il 30 novembre 2023, a condizione che entro la data del 31 dicembre 2022 il relativo ordine risulti accettato dal venditore e sia avvenuto il pagamento di acconti in misura almeno pari al 20%, il credito d’imposta è riconosciuto: nella misura del 40% del costo per la quota di investimenti fino a 2,5 milioni di euro; nella misura del 20% del costo per la quota di investimenti superiori a 2,5 milioni di euro e fino a 10 milioni di euro; nella misura del 10% del costo per la quota di investimenti superiori a 10 milioni di euro e fino al limite massimo di costi complessivamente ammissibili pari a 20 milioni di euro. Per gli investimenti effettuati in beni strumentali materiali nuovi 4.0 dal 2023 (senza alcuna prenotazione/acconto nel 2022) il credito d’imposta è invece riconosciuto nella misura dimezzata del 20%, 10% e 5%. Il Decreto Milleproroghe aveva fissato al 30 novembre 2023, anche il termine ultimo per l’effettuazione di investimenti in “altri beni strumentali” nuovi (ovvero “non 4.0”) per i quali, con riferimento all’anno 2022, spetta un credito d’imposta al 6%, a condizione che entro la data del 31.12.2022 il relativo ordine risulti accettato dal venditore e sia avvenuto il pagamento di acconti in misura almeno pari al 20% del costo di acquisizione. Per gli investimenti “non 4.0” effettuati nel 2023 e non “prenotati” non è più previsto alcun credito d’imposta. Ricordiamo infine che il termine per sostenere gli investimenti in beni immateriali 4.0 (ricompresi nell’Allegato B legge 232/16), prenotati nel 2022 con conferma d’ordine e acconto almeno pari al 20% versato al fornitore entro il 31/12/2022, è rimasto invece fissato al 30 giugno 2023. Riportiamo il testo vigente dell’art. 1 comma 1057 della L. 178/2020: “Alle imprese che effettuano investimenti in beni strumentali nuovi indicati nell’allegato A annesso alla legge 11 dicembre 2016, n. 232, a decorrere dal 1° gennaio 2022 e fino al 31 dicembre 2022, ovvero entro il 30 novembre 2023, a condizione che entro la data del 31 dicembre 2022 il relativo ordine risulti accettato dal venditore e sia avvenuto il pagamento di acconti in misura almeno pari al 20 per cento del costo di acquisizione, il credito d’imposta è riconosciuto nella misura del 40 per cento del costo, per la quota di investimenti fino a 2,5 milioni di euro, nella misura del 20 per cento del costo, per la quota di investimenti superiori a 2,5 milioni di euro e fino a 10 milioni di euro, e nella misura del 10 per cento del costo, per la quota di investimenti superiori a 10 milioni di euro e fino al limite massimo di costi complessivamente ammissibili pari a 20 milioni di euro.”.
