ISA E CPB: MODALITà PER ACQUISIRE GLI 'ULTERIORI DATI' DALL?"AGENZIA DELLE ENTRATE


L?"Agenzia delle Entrate definisce le regole per l?"accesso agli ulteriori dati necessari ai fini degli ISA e del concordato preventivo biennale, introducendo un sistema strutturale a partire da quest'anno. Ai fini della determinazione del punteggio di affidabilità relativo agli ISA e dell'elaborazione della proposta di concordato preventivo biennale (CPB), i contribuenti soggetti a tali strumenti devono utilizzare, oltre ai dati dichiarati nei modelli, anche specifiche informazioni messe a disposizione dall?"Agenzia delle Entrate. Tali dati, rilevanti anche per le finalità di semplificazione previste al comma 4-ter dell?"articolo 9-bis del decreto-legge n. 50/2017, sono resi disponibili dall'Agenzia delle Entrate ai contribuenti o ai loro intermediari specificamente delegati. Con il Provvedimento del 13 aprile l?"Agenzia delle Entrate definisce le modalità di acquisizione di queste informazioni, necessarie per l?"applicazione degli ISA a partire dal periodo d?"imposta 2025 e per l?"elaborazione delle proposte di CPB relative ai periodi d?"imposta 2026 e 2027. Una delle principali novità riguarda il carattere strutturale delle modalità di acquisizione di tali dati: a differenza del passato, infatti, non saranno più resi disponibili con provvedimenti annuali, ma entreranno stabilmente nel processo di elaborazione degli indici e delle proposte di concordato. Le modalità operative individuate tengono conto tengono conto delle novità introdotte dalle disposizioni in materia di "delega unica", prevista dall?"articolo 21 del Dl n. 1 del 2024 e disciplinata dai successivi provvedimenti attuativi del Direttore dell?"Agenzia. Tale sistema consente agli intermediari abilitati di accedere ai servizi online dell?"Agenzia delle Entrate e dell?"Agenzia delle Entrate-Riscossione con un?"unica delega, semplificando così la gestione degli adempimenti e l?"acquisizione dei dati necessari.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
