NUOVI CODICI TRIBUTO PER LA CESSIONE DEI CREDITI D'IMPOSTA PER ACQUISTO DI ENERGIA ELETTRICA, GAS NATURALE E CARBURANTE


Come noto, con specifici provvedimenti legislativi sono state introdotte misure agevolative in favore delle imprese, riconosciute nella forma del credito d’imposta, al fine di compensare parzialmente il maggior onere la queste sostenuto per l’acquisto di energia elettrica, gas naturale e carburante.  Questi crediti d’imposta possono essere utilizzati in compensazione oppure ceduti solo per intero a soggetti terzi. Con la Risoluzione n. 59/E dell'11 ottobre 2022 l'Agenzia delle Entrate ha istituito sei nuovi codici tributo per consentire ai cessionari dei suddetti crediti d'imposta, di utilizzarli in compensazione tramite modello F24. Li elenchiamo di seguito: “7727” denominato “CESSIONE CREDITO - credito d’imposta per l’acquisto di carburanti per l’esercizio dell’attività della pesca (secondo trimestre 2022) – art. 3-bis del decreto-legge 17 maggio 2022, n. 50”; “7728” denominato “CESSIONE CREDITO - credito d’imposta a favore delle imprese energivore (terzo trimestre 2022) – art. 6, c. 1, del decreto-legge 9 agosto 2022, n. 115”; “7729” denominato “CESSIONE CREDITO - credito d’imposta a favore delle imprese a forte consumo gas naturale (terzo trimestre 2022) – art. 6, c. 2, del decreto-legge 9 agosto 2022, n. 115”; “7730” denominato “CESSIONE CREDITO - credito d’imposta a favore delle imprese non energivore (terzo trimestre 2022) – art. 6, c. 3, del decreto-legge 9 agosto 2022, n. 115”; “7731” denominato “CESSIONE CREDITO - credito d’imposta a favore delle imprese diverse da quelle a forte consumo gas naturale (terzo trimestre 2022) – art. 6, c. 4, del decreto-legge 9 agosto 2022, n. 115”; “7732” denominato “CESSIONE CREDITO - credito d’imposta per l’acquisto di carburanti per l’esercizio dell’attività agricola e della pesca (terzo trimestre 2022) – art. 7 del decreto-legge 9 agosto 2022, n. 115”. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
