CREDITO D'IMPOSTA INVESTIMENTI NEL MEZZOGIORNO: COME COMPILARE IL MODELLO REDDITI 2022 NELL'IPOTESI DI IMPRESA FAMILIARE


In caso di impresa familiare, quali sono le corrette modalità di esposizione del credito d’imposta per investimenti nel mezzogiorno nei modelli Redditi SP e PF 2022, da parte di un soggetto che trasferisce il credito per trasparenza ex art. 5 TUIR e da parte del soggetto che lo riceve? In una risposta pubblicata sul proprio sito internet l'Agenzia delle Entrate chiarisce sul tema, precisando che: la società di persone che attribuisce il credito d’imposta ai propri soci deve indicare l’intero credito spettante nel quadro RU della propria dichiarazione Redditi SP, rigo RU5, col. 3, riportando lo stesso importo nel prospetto aiuti di Stato presente nel quadro RS (rigo RS401, col. 17), ed indicare poi l’ammontare complessivo del credito trasferito ai soci nel rigo RU10 della sezione I del quadro RU del modello SP.  L’importo esposto nel rigo RU10 va riportato anche nella sezione VI-B, indicando l’importo attribuito ai  soci e l’anno d’insorgenza del credito trasferito. Il socio della società di persone deve indicare il credito nel rigo RU3, dandone poi evidenza nella sezione VI-A (righi RU501-RU505). nel particolare caso di impresa familiare, il titolare dell’impresa deve indicare nei righi RU5 e RS401 del modello REDDITI PF 2022 l’importo del credito d’imposta maturato spettate all’impresa, al lordo della quota attribuita ai propri collaboratori (senza quindi esporre il dato di tale quota) e deve inserire nei righi da RU6 a RU12 gli importi relativi agli utilizzi e/o ai residui del predetto credito, con esclusivo riferimento alla sola quota di credito di propria spettanza, avendo altresì cura di barrare, a tal fine, la casella posta al rigo RU12 col. 1. Il collaboratore dell’impresa familiare, invece, deve riportare la quota di credito d’imposta ricevuta nel quadro RU, rigo RU3, della propria dichiarazione, in modo analogo a quanto previsto per i soci della società di persone, indicando nella colonna 4 della sezione VI-A il codice fiscale del titolare dell’impresa familiare.
