ANTIRICICLAGGIO: IL GARANTE Dà IL VIA LIBERA ALLA BANCA DATI INFORMATICA CENTRALIZZATA


Il Garante per la protezione dei dati personali ha dato parere favorevole all'istituzione, presso gli organismi di autoregolamentazione, di una banca dati informatica centralizzata con finalità di prevenzione dell'utilizzo del sistema finanziario a scopo di riciclaggio dei proventi di attività criminose e di finanziamento del terrorismo. Il database sarà alimentato dagli atti, utili ai fini delle valutazioni del rischio di riciclaggio, inviati dai professionisti (commercialisti, avvocati, notai, consulenti del lavoro) nell’esercizio della propria attività.   Tale innovazione, da un lato costituirebbe un patrimonio informativo di rilievo a cui potrebbero accedere le autorità competenti in ambito antiriciclaggio per lo svolgimento delle proprie funzioni (in particolare per l’effettuazione di analisi ed indagini su operazioni di riciclaggio o di finanziamento del terrorismo) e, dall'altro, costituirebbe un efficace strumento di ausilio per i singoli professionisti nell’adempimento dell’obbligo di segnalazione di operazioni sospette alle autorità competenti. L’avviso prodotto dal sistema in caso di operazioni rischiose consentirebbe, infatti, di garantire maggiore uniformità, da parte dei professionisti, nelle modalità di adempimento degli obblighi antiriciclaggio.   Fonte: https://www.garanteprivacy.it

The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
