CRISI D'IMPRESA: IL CNF CHIEDE DI UNIFICARE GLI ELENCHI E GLI ALBI DEI PROFESSIONISTI ESPERTI


Raccordare e unificare gli elenchi e gli albi dei professionisti esperti in crisi di impresa per rendere omogenea la formazione obbligatoria e l'aggiornamento, semplificando così anche l'impegno della Scuola superiore della magistratura di redigerne i programmi, e limitando l'aggravio di oneri a carico dei professionisti, specialmente per quelli più giovani, conseguenti alla obbligatoria partecipazione ai corsi di formazione. Questa la richiesta formulata dal Consiglio Nazionale Forense e inviata alla Ministra della Giustizia, Marta Cartabia, in merito al nuovo codice della crisi e dell'insolvenza, che entrerà in vigore il prossimo 15 luglio. Gli emendamenti presentati dal CNF riguardano, in particolare, gli articoli 356 e 358 del codice della Crisi. Il CNF propone inoltre di rendere la procedura di liquidazione controllata attivabile dal solo debitore e non anche dal pubblico ministero e dai creditori, come previsto dal decreto Insolvency.  Questo eviterebbe, spiega il Consiglio Nazionale, "da una parte di trovarsi di fronte a un enorme numero di procedure di difficile gestione da parte delle autorità giudiziali e, dall'altra, a un non trascurabile rischio d'incrementare le probabilità dell'odioso fenomeno della usura".   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
