CREDITO D'IMPOSTA "R&S": 4 CODICI TRIBUTO PER IL RIVERSAMENTO SPONTANEO


La procedura di riversamento spontaneo prevede che possano essere regolarizzati, senza sanzioni e interessi (articolo 5, commi 7-12, Dl 21 n. 146/2021), gli indebiti utilizzi in compensazione del credito di imposta per investimenti in attività di ricerca e sviluppo. Con Provvedimento del 4 luglio 2022 l'Agenzia delle Entrate ha approvato le specifiche tecniche per la trasmissione telematica dei dati relativi al modello di domanda per l'accesso alla procedura e, con successiva Risoluzione n. 34/E del 5 luglio, ha istituito i codici tributo per il riversamento spontaneo, tramite il modello “F24 Versamenti con elementi identificativi”, degli indebiti utilizzi in compensazione del suddetto credito di imposta. Si tratta di 4 codici tributo e, più precisamente: “8170” denominato “Riversamento spontaneo del credito d’imposta per attività di ricerca e sviluppo - articolo 5, commi da 7 a 12, del decreto-legge 21 ottobre 2021, n. 146 – UNICA SOLUZIONE”; “8171” denominato “Riversamento spontaneo del credito d’imposta per attività di ricerca e sviluppo - articolo 5, commi da 7 a 12, del decreto-legge 21 ottobre 2021, n. 146 – PRIMA RATA”; “8172” denominato “Riversamento spontaneo del credito d’imposta per attività di ricerca e sviluppo - articolo 5, commi da 7 a 12, del decreto-legge 21 ottobre 2021, n. 146 – SECONDA RATA”; “8173” denominato “Riversamento spontaneo del credito d’imposta per attività di ricerca e sviluppo - articolo 5, commi da 7 a 12, del decreto-legge 21 ottobre 2021, n. 146 – TERZA RATA”. Ricordiamo che l'agevolazione è riservata ai soggetti che intendono riversare il credito maturato in uno o più periodi di imposta a decorrere da 2015 e fino al 31 dicembre 2019 e utilizzato indebitamente in compensazione alla data di entrata in vigore del decreto n. 146/2021 (22 ottobre 2021). L’importo della regolarizzazione deve essere riversato entro il 16 dicembre 2022 in unica soluzione, oppure in tre rate annuali di pari importo, da corrispondere entro il 16 dicembre 2022, 16 dicembre 2023 e 16 dicembre 2024, senza avvalersi della compensazione di cui all’articolo 17 del decreto legislativo 9 luglio 1997, n. 241.  Fonte: https://www.agenziaentrate.gov.it

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
