PER CONTESTARE NEL MERITO IL CREDITO D'IMPOSTA RICERCA E SVILUPPO L'AGENZIA ENTRATE DEVE CHIEDERE IL PARERE AL MISE


Anche la CTP di Napoli (sentenza 4988/2022) ha recentemente limitato l’attività di recupero dei crediti di imposta ricerca e sviluppo (“R&S”) effettuata dall’Agenzia Entrate, ritenendo necessario, ai fini della sua legittimità, il preliminare parere del MISE senza il quale l’attività degli uffici è da qualificarsi caratterizzata da eccesso di potere. A quanto ci risulta l’Agenzia Entrate sta invocando in molti casi, pressoché “automaticamente” e senza riferimenti tecnici fondati, la disciplina del credito inesistente di cui all’articolo 13, comma 5, D.Lgs. 471/1997 che normalmente prevede: l’irrogazione di una sanzione dal 100% al 200% della misura del credito compensato; il divieto di definizione agevolata delle sanzioni; il termine di accertamento al 31.12 dell’ottavo anno successivo a quello di utilizzo del credito utilizzato in compensazione. Quando le imprese che hanno operato correttamente si sono però rivolte alle Commissioni tributarie, la giurisprudenza di merito si è espressa quasi sempre (come nel caso citato) in loro favore, riconoscendo che la facoltà riconosciuta all’Agenzia Entrate di richiedere al MISE un parere tecnico debba essere considerato un obbligo tutte le volte in cui la natura tecnica degli accertamenti è prevalente rispetto agli aspetti puramente amministrativi e manchi, all’interno dell’Agenzia, una professionalità specifica per condurre l’istruttoria.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
