ROAMING UE - INTRODOTTE NELL'ORDINAMENTO NAZIONALE LE SANZIONI DA APPLICARE IN CASO DI VIOLAZIONE DEL REGOLAMENTO SUI COSTI


E' stata pubblicata, sulla Gazzetta Ufficiale n. 277 del 27 novembre 2017, la Legge 20 novembre 2017, n. 167, recante "Disposizioni per l'adempimento degli obblighi derivanti dall'appartenenza dell'Italia all'Unione europea - Legge europea 2017". L'articolo 4, introdotto alla Camera, interviene sul D.Lgs. n. 259/2003 (Codice delle comunicazioni elettroniche - CCE) per introdurre nell'ordinamento nazionale le sanzioni da applicare in caso di violazione del regolamento sui costi del roaming UE nelle reti pubbliche di comunicazioni mobili e sul c.d. Internet aperto, in modo da rendere effettiva tale nuova disciplina europea. Si tratta, in particolare, di introdurre all'articolo 98 del D.Lgs. n. 259/2003, le sanzioni, nell'ambito delle reti e servizi di comunicazione elettronica ad uso pubblico, necessarie ad attuare efficacemente le nuove norme del regolamento roaming, per le quali il nostro ordinamento non prevede attualmente sanzioni specifiche. Ricordiamo che: l'art. 18 del regolamento 2012/531/UE, che disciplina il roaming sulle reti pubbliche di comunicazioni mobili nell'Unione, prevede l'obbligo degli Stati membri di comunicare alla Commissione (il termine era il 30 giugno 2013) le sanzioni adottate per la violazione delle sue disposizioni e di prendere tutti i provvedimenti necessari per la loro attuazione; l'art. 6 del regolamento 2015/2120/UE relativo all'accesso ad un Internet aperta, modifica anche il precedente regolamento del 2012 e fissa il termine per comunicare le sanzioni al 30 aprile 2016. In entrambi i casi è richiesto che le sanzioni siano effettive, proporzionate e dissuasive. In relazione a tali obblighi, formalmente in relazione al regolamento 2015/2120/UE, è stata infatti aperta, ad ottobre 2016, la procedura EU Pilot 8925/16/CNECT, con la quale si chiedevano chiarimenti sulla efficacia dissuasiva della legislazione nazionale per le violazioni delle norme europee da parte di alcuni operatori di telefonia mobile, che sono segnalate alla Commissione UE. L'articolo 4, comma 1, della legge europea 2017, per rimediare alla carenza legislativa del nostro ordinamento, provvede quindi ad introdurre i nuovi commi 16-bis, 16-ter, 16-quater, all'art. 98 (rubricato "Sanzioni") nel D. Lgs. n. 259 del 2003. Previsti: sanzioni amministrative pecuniarie che vanno da 120.000,00 a 2.500.000,00 euro, l'ordine di immediata cessazione delle violazioni nonché la condanna dell'operatore al rimborso delle somme ingiustificatamente addebitate agli utenti, indicando il termine entro cui adempiere, che non deve superare i trenta giorni (commi 16-bis e 16-ter). Nel caso l'Autorità ritenga sussistere "motivi di urgenza dovuta al rischio di un danno di notevole gravità per il funzionamento del mercato o per la tutela degli utenti", potrà adottare, sentiti gli operatori interessati e nelle more dell'adozione del provvedimento definitivo, "provvedimenti temporanei per far sospendere la condotta con effetto immediato". Previsto, inoltre, che l'AGCOM possa disporre la pubblicazione dei provvedimenti adottati a spese dell'operatore, sui mezzi ritenuti più idonei, anche su uno o più quotidiani a diffusione nazionale (comma 16-quater).
