ADESIONE AL REGIME DI ADEMPIMENTO COLLABORATIVO: L'AE MODIFICA IL MODELLO


A seguito delle modifiche intervenuto con l'emanazione del decreto Mef 31 gennaio 2022 e di quelle derivanti dall’entrata in vigore delle disposizioni contenute nell'articolo 20, comma 1 del Dl n. 119/2018 l'Agenzia delle Entrate, con Provvedimento del 4 maggio 2022, ha aggiornato il modello di adesione al regime di adempimento collaborativo e le relative istruzioni. In particolare, al modello sono state apportate le seguenti modifiche: nel campo “DICHIARAZIONE DEL POSSESSO DEI REQUISITI”, i periodi “non inferiore a dieci miliardi di euro” vengono variati in “non inferiore a un miliardo di euro”, viene inoltre inserito il nuovo campo: “possesso del requisito di cui comma 6-bis, dell’articolo 70-duodecies del Decreto del Presidente della Repubblica n. 633 del 1972 (appartenenza ad un Gruppo IVA ove almeno uno dei partecipanti abbia aderito o sia stato ammesso al regime di adempimento collaborativo)”; viene inserito il nuovo campo “DATI RELATIVI AL GRUPPO IVA”; il punto delle istruzioni rubricato “2. Soggetti interessati alla presentazione del modello”, viene variato per recepire le modifiche intervenute, in relazione all’estensione della platea dei contribuenti ammissibili al regime, a seguito dell’emanazione del Decreto del Ministro dell’Economia e delle Finanze del 31 gennaio 2022 e dell’entrata in vigore dell’articolo 20, comma 1, del decreto-legge 23 ottobre 2018, n.119 che ha inserito il nuovo comma 6-bis, all’articolo 70-duodecies del Decreto del Presidente della Repubblica 26 ottobre 1972, n. 633; nelle istruzioni al campo rubricato “3. modalità di presentazione della domanda” il periodo “Il presente modello, reso disponibile gratuitamente dall’Agenzia delle Entrate, in formato elettronico, sul sito internet www.agenziaentrate.gov.it, è sottoscritto e presentato all’ufficio competente per la valutazione dei requisiti di ammissibilità per l’accesso al regime individuato al punto 2.1 del provvedimento” è sostituito dal seguente: “Il presente modello, reso disponibile gratuitamente dall'Agenzia delle Entrate, in formato elettronico, sul sito internet www.agenziaentrate.gov.it., è sottoscritto e presentato all’Ufficio Adempimento collaborativo della Direzione Centrale Grandi contribuenti e internazionale”. Viene inoltre aggiornato l’indirizzo mail dell’Ufficio Adempimento collaborativo; nelle istruzioni al campo rubricato “7. Dichiarazione del possesso dei requisiti (da compilare solo nel caso di istanza di ammissione)” la parola “decreto” è sostituita con il periodo “dalla normativa di riferimento”.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
