NUOVA CLASSIFICAZIONE ATECO 2007: CHIARIMENTI DALL'AGENZIA ENTRATE


Con nota informativa del 29 dicembre 2021 l'Istat ha comunicato la pubblicazione della nuova Classificazione Ateco 2007 aggiornata al 2022, in vigore dal 1° gennaio 2022 e recepita a livello amministrativo dal 1° aprile 2022. Le modifiche, in particolare, riguardano l'aggiornamento di alcuni codici attività ed interessano 11 sezioni della classificazione, su un totale di 21, e sono introdotti 20 nuovi codici e aggiornate oltre 60 note di inclusione e di esclusione.  L'Agenzia Entrate chiarisce che i contribuenti sono tenuti a valutare, in base alla nuova Classificazione Ateco 2007 pubblicata dall'ISTAT, se il codice comunicato in precedenza sia stato oggetto di variazione. Gli operatori interessati all'aggiornamento dovranno utilizzare, negli atti e nelle dichiarazioni da presentare all'amministrazione finanziaria, i nuovi codici attività. Al fine di recepire la Tabella Ateco 2007 nel nuovo aggiornamento 2022 l'Agenzia delle entrate ha adeguato le funzioni di acquisizione dei modelli anagrafici e, con la Risoluzione n. 20/E del 4 maggio, chiarisce come verificare il codice attività attualmente presente in Anagrafe Tributaria e come comunicare la variazione. Le Entrate spiegano che l'adozione della nuova Classificazione Ateco 2007 non comporta l'obbligo di presentare un'apposita dichiarazione di variazione dati, ai sensi degli articoli 35 e 35-ter del Dpr n.633 /1972. Il nuovo codice sarà comunicato al Fisco in occasione della prima dichiarazione di variazione dati presentata secondo la disciplina Iva. Qualora, il contribuente presenti una dichiarazione di variazione dati l'Agenzia ricorda che: se è iscritto nel Registro delle Imprese, la dichiarazione dovrà essere effettuata con la Comunicazione Unica (ComUnica) messa a disposizione da Unioncamere; se non è iscritto al Registro delle Imprese, dovrà invece utilizzare uno dei modelli pubblicati sul sito internet dell' Agenzia delle entrate (A A7/10 per società, enti, associazioni, ecc.; AA9/12 per imprese individuali, lavoratori autonomi, artisti e professionisti, ecc.; AA5/6 per enti non commerciali, associazioni, ecc.).   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
