ETS: NELLA CIRCOLARE DEL MINISTERO DEL LAVORO I CHIARIMENTI PER L'ACCESSO AL RUNTS E LA TRASMIGRAZIONE DEI DATI


Con la Circolare n. 2 del 21 aprile 2022 il Ministero del Lavoro e delle Politiche Sociali fornisce chiarimenti relativi alla trasmigrazione dei dati delle ODV e delle APS iscritte ai Registri delle Regioni e delle Province autonome e al procedimento di verifica dei requisiti per l’iscrizione al RUNTS, con l'obiettivo di "garantire l’uniformità di trattamento sull’intero territorio nazionale, in ossequio al principio costituzionale di eguaglianza della normativa su tutto il territorio nazionale, oltreché di assicurare l’essenziale e irrinunciabile autonomia che deve caratterizzare i soggetti del Terzo settore" (sentenza Corte Cost. n. 185/2018). Nel documento sono definiti i criteri dell'attività istruttoria nel procedimento di iscrizione, compresa l’iscrizione al RUNTS degli enti già esistenti, la competenza degli uffici regionali del RUNTS e l'operatività territoriale degli ETS, oltre al procedimento di verifica post-trasmigrazione degli enti già iscritti nei registri precedenti. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
