BENEFICIO PRIMA CASA: PER IL CALCOLO DELLA "SUPERFICIE UTILE COMPLESSIVA" IRRILEVANTE IL REQUISITO DELL'ABILITABILITà


In tema di imposta di registro, per stabilire se una abitazione sia di lusso e, quindi, sia esclusa dall'agevolazione per l'acquisto della "prima casa", occorre fare riferimento alla nozione di "superficie utile complessiva", in forza della quale è irrilevante il requisito dell'abitabilità" dell'immobile, mentre quello dell'utilizzabilità" degli ambienti, a prescindere dalla loro effettiva abitabilità, costituisce parametro idoneo ad esprimere il carattere "lussuoso" di una abitazione.  Di conseguenza, è legittima la revoca del beneficio qualora possano computarsi nella superficie "utile" i vani posti al piano seminterrato e il piano sottotetto-soffitta e un vano deposito di un immobile (in quel caso non abitabili perché non conformi ai parametri previsti dal regolamento edilizio), assumendo rilievo - in coerenza con l'apprezzamento dello stesso mercato immobiliare - la marcata potenzialità abitativa dello stesso.
