Il Decreto Milleproroghe è legge


Con il voto di fiducia espresso in data 24 febbraio 2022 dall’Aula del Senato, il decreto “Milleproroghe” (D.L. 30 dicembre 2021, n. 228) è diventato legge. Molte le importanti disposizioni in materia fiscale e societaria, tra cui la sterilizzazione delle perdite anche sui bilanci 2021, la dilazione dei ruoli, la sospensione degli ammortamenti, il limite all’utilizzo del contante e tax credit beni strumentali. Il provvedimento attende ora la pubblicazione in Gazzetta Ufficiale. Si riporta una sintesi delle principali misure contenute nel Decreto: Riapertura dei termini per la dilazione dei ruoli: è stata estesa al 30 aprile 2022 la possibilità di richiedere la rateazione di carichi contenuti nei piani di dilazione per i quali, anteriormente alla data di inizio della sospensione di cui all’art. 68, commi 1 e 2-bis, del decreto “Cura Italia”, è intervenuta la decadenza dal beneficio. Bonus psicologo: è introdotto un contributo, nell’importo massimo di 600 euro per persona, parametrato alle diverse fasce ISEE, per sostenere le spese relative a sessioni di psicoterapia fruibili presso specialisti privati regolarmente iscritti nell’elenco degli psicoterapeuti nell’ambito dell’albo degli psicologi. Il contributo non spetta alle persone con ISEE superiore a 50.000 euro. Bonus prima casa: è estesa dal 31 dicembre 2021 al 31 marzo 2022 la sospensione dei termini per ottenere o mantenere l’agevolazione prima casa. Visto di conformità: sono detraibili anche le spese sostenute per il rilascio del visto di conformità, delle attestazioni e delle asseverazioni ed è stata disposta l’applicabilità di tale norma anche alle spese sostenute dal 12 novembre 2021 al 31 dicembre 2021. Assemblee: è stato prorogato al 31 luglio 2022 il termine fino al quale è possibile svolgere in videoconferenza le assemblee nonché le riunioni di consigli di amministrazione e collegi sindacali, a prescindere dalle previsioni statutarie. Sterilizzazione perdite: è stata estesa, come già previsto per il 2020, la possibilità di sterilizzare anche le perdite emerse nell’esercizio in corso alla data del 31 dicembre 2021. Quindi in relazione alle perdite dell’esercizio 2021, l’obbligo di ripianamento è differito fino al bilancio 2026. Sospensione degli ammortamenti: è stata estesa all’esercizio successivo a quello in corso alla data del 15 agosto 2020 la norma sul differimento degli ammortamenti contenuta nel decreto “Agosto”. Limite all’uso del contante: In materia di utilizzo del contante e di titoli al portatore, è stato prorogato fino al 31 dicembre 2022 il limite di 2.000 euro. Dal 1° gennaio 2023, tale limite si abbasserà a 1.000 euro. IVA nelle procedure concorsuali: Viene precisato che la nuova disciplina IVA relativa alle procedure concorsuali, che prevede la detraibilità del tributo in caso di mancato pagamento da parte del debitore, si applica alle procedure avviate dal 26 maggio 2021 compreso.
