SUPER GREEN PASS: ILLEGITTIMO CHIEDERLO DOVE LA LEGGE NON LO PREVEDE


Il Garante per la protezione dei dati personali è intervenuto ancora una volta in tema di Green Pass, ed in particolare di super green pass (o green pass rafforzato). A seguito di segnalazioni di cittadini che lamentavano l'uso da parte di albergatori o datori di lavoro dell'app per il green pass rafforzato invece della versione base, e quindi si vedevano negato l'accesso con il solo tampone all'albergo o al luogo di lavoro, l'Autorità ha chiarito che, come previsto per legge e come chiaramente indicato dalle Faq predisposte dal Ministero della salute, non c'è alcun obbligo di possedere il cosiddetto "Super green pass" per i clienti degli alberghi, i lavoratori o, ad esempio, gli accompagnatori dei pazienti negli ospedali. L'uso della app per il Super green pass per queste categorie di soggetti è dunque illegittimo. Nella nota del 10 dicembre scorso il Garante ha inoltre precisato che, in vista della revisione del Dpcm del 17 giugno scorso, ha già indicato al Ministero della salute le misure per evitare l'uso non corretto della funzionalità dell'app di verifica riservata ai green pass rafforzati, in particolare per quanto riguarda l'ambiente lavorativo. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
