PUBBLICATA LA LEGGE DI DELEGAZIONE EUROPEA 2016-2017


E' stata pubblicata, sulla Gazzetta Ufficiale n. 259 del 6 novembre ottobre 2017, la Legge 25 ottobre 2017, n. 163, recante "Delega al Governo per il recepimento delle direttive europee e l'attuazione di altri atti dell'Unione europea - Legge di delegazione europea 2016-2017". La legge, che si compone di 15 articoli e di un solo allegato, conferisce la delega al Governo per il recepimento di 29 direttive europee, di cui 28 inserite nell'Allegato A, che dovranno essere recepite con decreto legislativo. Si tratta, prevalentemente, di direttive emanate nell'anno 2016 (23); le restanti direttive risultano emanate negli anni 2015 (3) e 2017 (3). Il provvedimento reca, inoltre, disposizioni di delega riguardanti l'adeguamento della normativa nazionale a 8 regolamenti europei e alle disposizioni dell'Accordo su un tribunale unificato dei brevetti. Si tratta di norme destinate a integrare l'ordinamento nazionale o a disciplinare ex novo aspetti della vita economica, sociale e sanitaria dei cittadini italiani in ambiti estremamente differenziati: dalla disciplina dei pacchetti turistici e dei servizi collegati a quella dei marchi d'impresa; dalla regolamentazione della distribuzione assicurativa, alla trasparenza delle operazioni di finanziamento tramite titoli: dal rafforzamento di alcuni aspetti della presunzione d'innocenza e del diritto di presenziare al processo nei procedimenti penali, alle garanzie per i minori indagati o imputati nei procedimenti penali; dalla protezione dei dati personali nelle attività di indagine, all'accessibilità dei siti web e delle applicazioni mobili degli enti pubblici; dall'interoperabilità del sistema ferroviario dell'UE e la sicurezza delle ferrovie e delle navi passeggeri, alla riduzione delle emissioni nazionali di determinati inquinanti atmosferici. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
