LIQUIDAZIONI PERIODICHE IVA: COME RIMEDIARE IN CASO DI IRREGOLARITà


Con il Provvedimento del 7 ottobre 2021 l'Agenzia delle Entrate, al fine di favorire l'adempimento spontaneo, definisce le modalità con le quali mette a disposizione del contribuente e della Guardia di Finanza, anche tramite l'utilizzo di strumenti informatici, le informazioni derivanti dal confronto tra le fatture elettroniche emesse dal contribuente, i corrispettivi memorizzati e trasmessi telematicamente o le comunicazioni delle operazioni transfrontaliere inviate dal contribuente stesso e le Comunicazioni liquidazioni periodiche IVA.  L'Agenzia trasmette, agli indirizzi di Posta Elettronica Certificata attivati dai contribuenti, una comunicazione che li avvisa delle anomalie riscontrate, che quest'ultimi potranno verificare all'interno del portale "Fatture e Corrispettivi", nella sezione "Consultazione", area "Fatture elettroniche e altri dati IVA". Destinatari delle suddette comunicazioni sono, in particolare, i contribuenti ai quali non è pervenuta la Comunicazione liquidazioni periodiche IVA per il trimestre di riferimento, sebbene risultino aver emesso fatture nello stesso periodo o memorizzato e trasmesso corrispettivi o comunicato transazioni con l'estero.  I contribuenti venuti a conoscenza delle eventuali anomalie riscontrate potranno regolarizzare la propria posizione mediante l'istituto del ravvedimento operoso. Nel provvedimento anche le modalità con le quali i contribuenti possono richiedere informazioni o comunicare all'Agenzia delle entrate eventuali elementi, fatti e circostanze dalla stessa non conosciuti. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
