PROVVEDIMENTI SANZIONATORI PER I REVISORI: IL REGOLAMENTO IN GAZZETTA UFFICIALE


Sulla Gazzetta Ufficiale n. 237 del 4 ottobre 2021 è stato pubblicato il Regolamento che disciplina la procedura per l'adozione di provvedimenti sanzionatori da parte del MEF, in caso di violazione delle disposizioni in materia di revisori legali e società di revisione, ai sensi dell'articolo 25, comma 3-bis, del DL 27 gennaio 2010, n. 39.  L'art. 3, in particolare, prevede che il MEF, nell'esercizio dei compiti di vigilanza in materia di revisione legale, provveda ad accertare la violazione per la quale è prevista una sanzione amministrativa una volta acquisiti gli elementi necessari a valutarne la sussistenza. Se le violazioni ascrivibili al revisore legale o alla società di revisione legale risultano da precedenti atti adottati nell'esercizio dei compiti di vigilanza, quale un verbale ispettivo o le risultanze di un controllo della qualità ai sensi dell'articolo 20 del decreto legislativo, tali atti devono essere allegati al verbale di accertamento, salvo che non se ne riproduca il contenuto essenziale. L'accertamento si perfeziona con la redazione del verbale di accertamento, che resta conservato agli atti del MEF. Dalla data di redazione del verbale di accertamento, che viene comunicata nella lettera di contestazione, decorrono i termini per la contestazione degli addebiti, ossia 180 giorni dall'accertamento, o 360 giorni se l'interessato risiede o ha la sede all'estero.  La lettera di contestazione degli addebiti dovrà contenere il riferimento all'attività di vigilanza svolta e alla documentazione acquisita dalla quale sia emersa la violazione.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
