Verifica C19 dal 15 ottobre 2021 - spigolature e privacy


Per la verifica sul possesso della certificazione verde l'unico metodo di verifica ammesso è quello dell'uso dell'apposita APP, messa a disposizione gratuitamente e scaricabile su un qualsiasi smartphone. La prima domanda che sorge è: per gli operatori economici e per i privati che hanno alle dipendenze colf e badanti è quindi stato istituito indirettamente per legge l'obbligo di acquistare e, soprattutto saper utilizzare, uno smartphone? La nonnina di 90 anni compiuti dovrà delegare formalmente la nipote ad effettuare la verifica della propria badante? Un altro nodo da sciogliere è l'intreccio tra tutela dei dati personali e verifica del certificato verde: ad esempio nel mio studio con una certa frequenza accedono, oltre dipendenti e collaboratori, il tecnico della macchina erogatrice di bevande, l'elettricista, il programmatore etc.etc., tutte le volte che entrano debbo effettuare la verifica? Le risultanze dell'uso dell' APPVerificaC19 sono, come suggerito dal Garante Privacy nel proprio parere, dati "minimizzati", cioè cognome e nome, data di nascita ed il segnale "verde" di validità, nessun altro dato. Se invece mi viene esibito l'ìntero certificato in forma cartacea ho modo di apprendere anche che la certificazione è valida 270 giorni (vedi nota infra riportata) dalla data dell'ultima somministrazione, in modo da poter determinare un'esatta data di scadenza e non dover ricorrere, magari tutti i giorni, alla verifica nei confronti dei dipendenti; l'annotare su un foglio l'avvenuta verifica in data di oggi nei confronti di un dipendente oltre alla data di scadenza di validità della certificazione non è a mio ultra modesto avviso una violazione dei dati personali del dipendente, essendo unicamente oggetto di annotazione il cognome e nome  ed una data (neppure da trascrivere l'identificativo univoco del certificato), senza alcun altro dato - ex sensibile o meno - dell'interessato ed in un'ottica di semplificazione degli adempimenti, specie nelle micro imprese.   La validità della certificazione verde dalle FAQ sito del Governo: Si rammenta che a partire dal 19 settembre 2021, la validità delle Certificazioni verdi Covid-19 già emesse per completamento del ciclo vaccinale verrà automaticamente portata a 12 mesi dalla Piattaforma nazionale DGC. L'App di verifica applicherà i nuovi criteri di validità semplicemente leggendo il QR Code, che non cambierà, anche se nella certificazione vi è ancora scritto "Validità in Italia: 9 mesi". Per un breve periodo transitorio dopo la pubblicazione in Gazzetta ufficiale della Legge di conversione del Decreto legge 105 del 2021, anche le nuove Certificazioni potrebbero riportare scritto "Validità in Italia: 9 mesi", ma saranno comunque valide 12 mesi. Nota di studio: la seconda dose è stata iniettata post 31.12.2020 e quindi la validità delle certificazioni rilasciate a seguito della seconda somministrazione è posteriore al 31 dicembre 2021, termine entro il quale cesseranno le disposizioni di cui sopra.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
