SI' AL SUPERBONUS ANCHE SE L'INSTALLAZIONE DEI PANNELLI SOLARI è REALIZZATA SU UN EDIFICIO ADIACENTE


Con la Risposta ad interpello n. 614/2021 l'Agenzia delle Entrate ha esaminato il caso di un contribuente che intende realizzare un intervento di riqualificazione energetica su un edificio unifamiliare detenuto in comodato d'uso e rientrante nell'ambito di applicazione del Superbonus. In particolare il contribuente vorrebbe realizzare, come intervento "trainato", un impianto fotovoltaico a servizio dell'abitazione (con l'impianto e le relative apparecchiature realizzate all'interno dell'unità immobiliare sopra citata) installando invece i pannelli sulla falda del tetto dell'edificio adiacente all'edificio oggetto dell'intervento. L'Agenzia Entrate in proposito chiarisce che, nel presupposto che sussistano tutti i requisiti previsti per la fruizione della normativa agevolativa e, in particolare, che venga effettivamente realizzato un intervento trainante sull'edificio che verrà servito dall'impianto fotovoltaico, il contribuente può fruire del Superbonus per tale intervento anche quando l'installazione, come nel caso in esame, sia effettuata su un edificio diverso da quello oggetto degli interventi agevolati su cui detiene la comproprietà dell'area necessaria all'installazione stessa. L'Agenzia ricorda che, già con la Circolare n. 30/E, era stato precisato che l'agevolazione spetta anche nel caso in cui l'installazione sia effettuata in un'area pertinenziale dell'edificio in condominio. Dunque, anche il tetto adiacente al fabbricato da ristrutturare può rientrare in tale estensione. Successivamente, anche la legge di bilancio 2021, modificando il comma 5 dell'articolo 119 del Decreto Rilancio, ha previsto che l'installazione di impianti solari fotovoltaici possa avvenire anche «su strutture pertinenziali agli edifici», confermando quindi la volontà del legislatore di estendere il più possibile la fruizione dell'agevolazione.
