Tar Campania: chiusura illegittima per emergenza sanitaria - indennizzo alla società


Data  04/02/2021 n. 01219/2020 Reg.Ric. n. 00789/2021 Reg.Prov.Coll. La Società era oggetto di un provvedimento della Prefettura di Napoli con cui veniva disposta la sospensione coatta ed immediata  dell'attività  di commercio all'ingrosso di materiale elettrico, a seguito del lockdown generalizzato della primavera 2020 secondo le disposizioni di cui al D.P.C.M. 22 marzo 2020. Si rammenta che il D.P.C.M. suindicato prevedeva attività che potevano continuare ad essere esercitate, attività di erogazione di servizi essenziali e, in ultimo, attività funzionali alle attività di cui in precedenza e, in quest'ultima categoria doveva essere annoverata quella esercitata dalla Società, a tal fine la stessa aveva inoltrato apposita comunicazione alla Prefettura di Napoli, corredata da numerose attestazioni proveniente dagli acquirenti dei propri prodotti, tra i quali ordinativi di enti pubblici, dimostrando così di far parte integrante e "funzionale" della filiera produttiva. La Prefettura di Napoli, sulla base di istruttoria del Comando Provinciale della GdF riteneva non sussistere i presupposti di cui all'art. 1 lettera d) del Decreto Mise 25 marzo 2020, DPCM 1 aprile 2020, emanando il provvedimento di sospensione dell'attività sopra indicato. La Sentenza evidenzia la fondatezza di quanto sostenuto dalla Società, precisando che la norma prevedeva la "funzionalità" dell'attività e non la "essenzialità", elemento quest'ultimo che sembra postulare dal decreto prefettizio. L'omessa valutazione degli apporti  forniti dal Società determinano quindi l'illegittimità del provvedimento finale per difetto di motivazione, l'illegittimità dell'atto rappresenta elemento idoneo a presumere la colpa della Pubblica Amministrazione che, peraltro, può provare il contrario. Si verifica così un "danno da disturbo", lesione di un interesse legittimo, con compressione delle facoltà di cui il cittadino era già titolare: nel caso in esame la Società ha subito l'interruzione ingiustificata dell'attività commerciale. In tema di risarcimento del danno la Società ha prodotto una relazione di stima di un perito di parte fondata esclusivamente sul raffronto di fatturato aprile 2019/2020 senza che siano state prodotte le scritture contabili ed i bilanci, in modo da poter considerare quale sarebbe stato l'utile netto conseguibile dalla vendita dei prodotti il Collegio ritiene di determinare il risarcimento su base equitativa per la valutazione del lucro cessante, stabilendo il risarcimento in euro 5.000 oltre agli interessi al tasso legale, condannando la P.A. al rimborso delle spese di giudizio che si liquidano in euro 1.500.
