Esecuzioni Immobiliari: Informativa per il debitore


Estratto dalle linee guida approvate dal Consiglio Superiore della Magistratura.Con l'intento di dare evidenza e agevolare la diffusione delle importanti linee guida in materia di buone prassi nel settore delle esecuzioni immobiliari proposte dalla VII commissione ed approvate all'unanimità dal plenum del Consiglio Superiore della Magistratura nella seduta del 11 ottobre 2017, www.AteneoWeb.com pubblica e rende gratuitamente disponibile in formato rielaborabile l' "Informativa per il debitore" (Allegato 1 alle linee guida). Come indicato dal CSM, "L'informativa per il debitore non è un atto previsto espressamente dalla legge ma, nella migliore prassi degli uffici giudiziari, viene predisposta e consegnata dal custode al debitore all'atto del primo accesso per rendergli noto, con espressioni semplici ed agevolmente comprensibili, cosa sta accadendo, lo svolgimento futuro della procedura, le possibilità che gli sono offerte dall'ordinamento per impedire la vendita coattiva del suo bene che, talvolta, è la casa di abitazione familiare; nella informativa gli sono, perciò, indicati in generale tutti i suoi diritti." I Custodi, in occasione del primo accesso, illustrano al debitore la propria funzione e si prodigano per rendere chiari i suoi diritti, consegnando un foglio riepilogativo; il prezioso intervento da parte del CSM ha permesso di ottenere un documento chiaro e completo, che verrà auspicabilmente adottato da tutti i Tribunali in modo omogeneo. L'iniziativa della VII commissione del CSM è infatti volta a promuovere e diffondere le buone prassi organizzative nel campo delle esecuzioni immobiliari, al fine di velocizzare i procedimenti giudiziari ed assicurare la tutela sia dei creditori che dei debitori, incrementare l'efficienza degli uffici giudiziari e quindi l'efficacia della risposta alla domanda di giustizia. Nell'allegata "Informativa per il debitore" le parti evidenziate in giallo sono alternative al testo che le precede e pertanto potranno essere indicate diversamente in ogni Tribunale a seconda della prassi stabilita dai Giudici delle Esecuzioni.
