I CHIARIMENTI DELLE ENTRATE SUL NUOVO PATENT BOX


L'articolo 4 del Decreto crescita (Dl n. 34/2019) ha apportato importanti modifiche al regime opzionale di tassazione agevolata (c.d. "Patent Box") dei redditi derivanti dall'utilizzo di alcuni beni immateriali. La Circolare n. 28 del 29 ottobre 2020 dell'Agenzia delle Entrate contiene chiarimenti sulle nuove modalità di fruizione del suddetto regime, e propone soluzioni interpretative tenendo conto dei quesiti e dei contributi pervenuti da rappresentanti di Associazioni di categoria, delle Professioni libere e dagli operatori a seguito di consultazione pubblica. Il documento, in particolare: definisce le caratteristiche del regime di "autoliquidazione" del beneficio derivante dall'utilizzo diretto dei beni agevolabili, fornendo chiarimenti sull'ambito soggettivo e oggettivo di applicazione e indicazioni operative sul rapporto tra l'opzione Patent box e l'opzione di "autoliquidazione". fornisce soluzioni interpretative sulle condizioni e sugli effetti del regime "fai da te", anche nelle ipotesi di rinuncia alle procedure di ruling pendenti e per coloro che hanno già autoliquidato negli esercizi pregressi. fornisce chiarimenti in merito alla documentazione che il contribuente deve predisporre per consentire il riscontro, da parte dell'Agenzia, della corretta determinazione della quota di reddito escluso.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
