INCOMPATIBILITà TRA L'ESERCIZIO DI ATTIVITà DI IMPRESA E L'ISCRIZIONE NELL'ELENCO DIFENSORI TRIBUTARI: LA RISPOSTA DEL MEF


Con la Risoluzione n. 7/DF del 22 ottobre 2020 il Ministero dell'Economia e delle Finanze risponde ad un quesito in tema di incompatibilità per l'iscrizione elenco difensori tributari ed esercizio attività d'impresa. In particolare la Risoluzione risponde a un quesito volto a conoscere la sussistenza di una incompatibilità tra l'iscrizione nell'Elenco Unico Nazionale dei soggetti abilitati alla rappresentanza dei contribuenti innanzi alle CC.TT. e l'esercizio di attività d'impresa complementari ed accessorie all'attività di esperto tributarista, mediante società "di mezzi" o "di servizi", delle quali il soggetto iscritto sia socio. Richiamando le disposizioni di cui alla legge 14 gennaio 2013, n. 4, che prevede che l'attività di tributarista possa essere svolta anche in forma societaria, il MEF chiarisce quanto segue: qualora il soggetto abilitato alla difesa innanzi alle Commissioni tributarie risulti esercitare l'attività professionale in forma societaria in base alle disposizioni di cui sopra, che disciplinano la professione non organizzata in ordini e collegi, le condizioni preclusive previste dall'articolo 9, comma 2, del regolamento n. 106/2019, non risultano applicabili. laddove, invece, l'esercizio dell'attività professionale in forma societaria non avvenga in base alle disposizioni contenute nella suddetta legge n. 4/2013, l'iscrizione negli elenchi di cui all'articolo 12 del D.Lgs. n. 546/92, può essere mantenuta a condizione che il professionista non rivesta nella società la qualifica di: socio illimitatamente responsabile o amministratore di società di persone, aventi quale finalità l'esercizio di attività di impresa commerciale; amministratore unico o consigliere delegato di società di capitali, anche in forma cooperativa; presidente di consiglio di amministrazione con poteri individuali di gestione.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
