DEDUCIBILI DAL REDDITO AUTONOMO I CONTRIBUTI OBBLIGATORI DEI NOTAI


Con la Risoluzione n. 79/E del 2002 l'Agenzia Entrate, contrariamente a quanto espresso dalla Corte di Cassazione nella sentenza n. 2781 del 2001, ha chiarito che i contributi previdenziali e assistenziali obbligatori per legge versati dai notai alla Cassa Nazionale del Notariato si deducono esclusivamente dal reddito complessivo del contribuente e non da quello di lavoro autonomo. I contributi in questione, infatti, data la loro finalità previdenziale ed assistenziale attinente esclusivamente alla sfera personale del lavoratore, non possono rappresentare un costo sostenuto in funzione della produzione del reddito di lavoro autonomo. Nel tempo la Cassazione ha però confermato il proprio orientamento con successive pronunce contrarie alle tesi dell'Amministrazione finanziaria, in particolare con l'ordinanza n. 321 del 10 gennaio 2018, con la quale ha confermato la deducibilità di tali contributi nella determinazione del reddito di lavoro autonomo ai sensi dell'articolo 54, comma 1, del TUIR, in quanto costi inerenti all'attività professionale. Con la Risoluzione n. 66/E del 12 ottobre 2020 l'Agenzia delle Entrate, preso atto dello sfavorevole indirizzo della giurisprudenza di legittimità, ha ritenuto superato quanto affermato con la precedente risoluzione n. 79/E del 2002 ed ha riconosciuto ai contributi previdenziali e assistenziali obbligatori per legge versati dai notai alla Cassa Nazionale del Notariato la deducibilità ai fini della determinazione del reddito di lavoro autonomo e, quindi, del calcolo della base imponibile IRAP.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
