NON VALE TRASFERIRE LA RESIDENZA PER NON PAGARE L'IMU


L'ordinanza n. 20130 del 24.09.2020 della Corte di Cassazione consentirà, con fondato motivo, ai comuni italiani di attivarsi, potendo retroagire per cinque anni, al fine di verificare la sussistenza dei requisiti di esenzione previsti in tema di IMU dall'art. 13, comma 2 del D.L. n. 201 del 2011. Tale norma prevede che: "L'imposta municipale propria non si applica al possesso dell'abitazione principale e delle pertinenze della stessa, ad eccezione di quelle classificate nelle categorie catastali A/1, A/8 e A/9 (...). Per abitazione principale si intende l'immobile, iscritto o iscrivibile nel catasto edilizio urbano come unica unità immobiliare, nel quale il possessore ed il suo nucleo familiare dimorano abitualmente e risiedono anagraficamente". Ciò comporta la necessità, che in riferimento alla stessa unità immobiliare, tanto il possessore quanto il suo nucleo familiare non solo vi dimorino stabilmente, ma vi risiedano anche anagraficamente. Conformemente all'orientamento costante espresso dalla Corte di Cassazione, in ordine alla natura di stretta interpretazione delle norme agevolative (tra le molte, in tema di ICI, più di recente, cfr. Cass. sez. 5, 11 ottobre 2017, n. 23833; Cass. sez. 6-5, ord. 3 febbraio 2017, n. 3011), condiviso anche dalla Corte costituzionale (cfr. Corte Cost. 20 novembre 2017, n. 242). Non è possibile quindi per lo stesso nucleo familiare avere due abitazioni principali, con la conseguenza che entrambe saranno soggette all'imposizione fiscale. La nuova normativa prevista dalla L. 27.12.2019 n. 160 (Finanziaria 2020, all'art. 1 comma 741, lett.b) ricalca la vecchia, pertanto tale interpretazione potrebbe estendersi anche per le situazioni in essere dopo il 01.01.2020.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
