IMPRESE DI COSTRUZIONE: PER I BENEFICI FISCALI DEL "DECRETO CRESCITA" NON IMPORTA SE L'INTERO FABBRICATO SIA ACQUISTATO CON PIù ATTI


L'articolo 7 del decreto legge 30 aprile 2019, n. 34 (Decreto "Crescita") prevede, fino al 31 dicembre 2021, l'applicazione dell'imposta di registro e delle imposte ipotecaria e catastale nella misura fissa di euro 200 ciascuna, in relazione all'acquisto di interi fabbricati da parte di imprese di costruzione o di ristrutturazione immobiliare che, entro i dieci anni successivi all'acquisto, provvedano alla ristrutturazione o alla demolizione e ricostruzione degli stessi, allo scopo di renderli più "sicuri" rispetto agli eventi sismici e più "ecologici", migliorandone le caratteristiche di efficienza energetica. Tale obiettivo, chiarisce l'Agenzia Entrate nella Risposta n. 384 del 18 settembre 2020, può essere perseguito indipendentemente dalla circostanza che l'impresa acquisti l'intero fabbricato tramite la redazione di diversi contratti di compravendita stipulati in tempi diversi. L'importante è che siano rispettati tutti i requisiti previsti dalla suddetta norma, ossia che: l'acquisto sia stato effettuato entro il 31 dicembre 2021 da un'impresa che svolge attività di costruzione e ristrutturazione di edifici; la società abbia acquistato un "intero fabbricato"; la società provveda, entro 10 anni dall'acquisto, alla ristrutturazione dell'edificio con un intervento che rientra tra quelli previsti dall'art. 3 comma 1 lettere b), c) e d) del D.P.R. n. 380/2001 e conforme alla normativa antisismica, che consentirà il conseguimento della classe energetica A o B; a fine lavori il fabbricato sia venduto.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
