CONCETTO DI INERENZA DEI COSTI


Con la sentenza n. 19341 del 17.09.2020 la Corte di Cassazione si è uniformata al principio secondo cui l'inerenza debba essere valutata secondo un giudizio di carattere qualitativo e non quantitativo, correlato all'attività di impresa; con la conseguenza che, in tema di IVA, la detrazione non possa essere esclusa solo in virtù di un mero giudizio fondato sulla congruità del costo, salvo che l'amministrazione finanziaria dimostri la macroscopica antieconomicità dell'operazione, la quale costituisce elemento sintomatico dell'assenza di correlazione dell'operazione IVA con lo svolgimento dell'attività imprenditoriale (Cass., Sez. V, 28 dicembre 2018, n. 33574). Tali affermazioni costituiscono un corollario della neutralità dell'IVA, che impone la detraibilità dell'IVA assolta a monte, in quanto l'IVA non può essere un costo per un committente (cessionario) che sia soggetto IVA, salvo che risulti che l'operazione sia estranea all'attività imprenditoriale, sia in quanto bene destinato a esigenze private (Corte di Giustizia UE, 20 gennaio 2005, Hotel Scandic G'àsalAck, C-412/03, punto 23), sia in quanto non vi sia un nesso diretto tra il servizio prestato e il corrispettivo ricevuto (Corte di Giustizia UE, 6 ottobre 2009, SPÒ Landesorganisation I.Krnten, C-267/08, punto 19; Corte di Giustizia UE 2 giugno 2016, Lajvér, C-263/15, punto 26), ovvero nel caso in cui venga dedotta la inesistenza della operazione sottostante l'emissione della fattura, ovvero la falsità della fattura (Cass., n. 33574/2018, cit.). La CTR, nello statuire che i costi per consulenze legali non siano riferibili ad attività dirette alla produzione del reddito della newCo, non si è attenuta a tale principio, non avendo accertato, ai fini dell'esclusione della detrazione, la macroscopica antieconomicità dell'operazione, ossia la «evidente incongruità dell'operazione» (Cass., n. 33574/2018 cit.).   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
