RICONOSCIMENTO DEI COSTI DI PRODUZIONE NELL'ACCERTAMENTO INDUTTIVO "PURO"


Con l'ordinanza n. 19293 del 16.09.2020 la Corte di Cassazione conferma il consolidato principio secondo cui (Cass. Sez. 5, Ordinanza n. 22868 del 29/09/2017) in tema di imposte sui redditi, l'Amministrazione finanziaria deve riconoscere una deduzione in misura percentuale forfettaria dei costi di produzione soltanto in caso di accertamento induttivo "puro" ex art. 39, comma 2, del d.P.R. n. 600 del 1973, mentre in caso di accertamento analitico o analitico presuntivo (come in caso di indagini bancarie) è il contribuente ad avere l'onere di provare l'esistenza di costi deducibili, afferenti ai maggiori ricavi o compensi, senza che l'Ufficio possa, o debba, procedere al loro riconoscimento forfettario. Sempre la medesima ordinanza ritiene che, quanto all'IVA, va fatta applicazione della costante giurisprudenza della Corte di Cassazione, secondo la quale (in ultimo Cass. Sez. 5, Ordinanza n. 21828 del 07/09/2018) proprio in tema di IVA, ove l'Amministrazione finanziaria, nell'ipotesi di omessa fatturazione, abbia proceduto ad accertamento induttivo "puro" ex art. 39, comma 2, del d.P.R. n. 600 del 1973, la base imponibile deve essere determinata ai sensi dell'art. 13 del d.P.R. n. 633 del 1972, con la conseguenza che non assumono alcuna incidenza i costi di produzione dei beni o servizi ceduti.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
