SCISSIONE DELLA NOTIFICA: TRASMESSI GLI ATTI AL PRIMO PRESIDENTE PER L'EVENTUALE RIMESSIONE ALLE SEZIONI UNITE


Con l'ordinanza interlocutoria n.15545 depositata il 21.07.2020, la Sezione tributaria della Corte di Cassazione ha disposto la trasmissione degli atti al Primo Presidente affinché valuti l'opportunità di rimettere alle Sezioni unite civile, ai sensi dell'art. 374, comma 2, c.p.c., le seguenti questioni su contrasto nonché di massima di particolare importanza con riferimento alla notificazione degli atti di imposizione tributaria: se il principio della scissione degli effetti della notificazione sia applicabile quando essa non sia effettuata dall'ufficiale giudiziario, ma dal messo speciale autorizzato, ex art. 60, comma 1, lett. a), d.P.R. n. 600/1973 e art. 16, comma 4, del d.lgs. n. 546/1992, che (a prescindere dalla qualifica formale da attribuire allo stesso, ossia se si tratti di dipendente dell'Agenzia delle Entrate, o di mero incaricato) è pur sempre un organo ad essa interno. Così stando le cose, la Corte di Cassazione ha fondato motivo di dubitare possa in tal caso ravvisarsi quella esigenza del bilanciamento degli interessi che costituisce il fondamento del suddetto principio della scissione, come pure argomentato da Cass., Sez. Un. n. 12332/2017, perché il tempo occorrente per il perfezionamento della notifica continua a scorrere sotto il totale controllo della stessa Agenzia delle Entrate (cui è riferibile il messo notificatore speciale, in base al detto rapporto organico). In tal caso, dunque, pare inevitabile trarre la conseguenza che il mancato perfezionamento della notifica anche per il destinatario entro il termine fissato dalla legge non possa che comportare la decadenza dell'Ufficio. In attesa della decisione delle Sezioni Unite il consiglio è quindi quello di inserire, fin da ora, tale argomento quale motivo di impugnazione nel ricorso, non essendo altrimenti rilevabile d'ufficio e non essendo proponibile quale motivo aggiunto (Cass. 03.10.2018 n. 24074).
