EFFETTI DELLA SENTENZA PENALE SUL PROCEDIMENTO TRIBUTARIO


Nel contenzioso tributario nessuna automatica autorità di cosa giudicata è attribuibile alla sentenza penale irrevocabile emessa in materia di reati tributari, anche se i fatti esaminati sono gli stessi che fondano l'accertamento. Nel processo tributario, infatti, da un lato, vigono i limiti in tema di prova stabiliti dall'art. 7, comma 4, del D. Lgs. 546/1992, dall'altro, trovano ingresso anche presunzioni semplici, in assoluto non idonee a supportare una pronuncia penale di condanna. Così spiegano i giudici della CTR Calabria con la sentenza del 27.01.2020 n.417. Erano però i giudici della sezione n. 4 perché qualche giorno prima la stessa CTR Calabria, però la sezione n. 3, aveva detto l'esatto contrario, ovvero che il giudice tributario deve uniformarsi al giudizio penale, con la sentenza del 23.01.2020 n. 406. Purtroppo, più frequentemente di quanto si pensi, i contrasti sorgono addirittura fra sezioni diverse della stessa commissione tributaria, con buona pace per il contribuente.
