PER I SOGGETTI RESIDENTI IN PAESI EXTRA UE DIVIETO DI ACCESSO ALLA LIQUIDAZIONE IVA DI GRUPPO


Con la risoluzione n. 22/E del 21 febbraio 2005 l'Agenzia delle entrate ha chiarito che la procedura di liquidazione dell'IVA di gruppo (art. 73, comma 3, D.P.R. n. 633/1972) trova applicazione anche per le società residenti in altri Stati comunitari, purché in possesso dei requisiti previsti dal citato D.M. 13 dicembre 1979, ed identificati ai fini IVA in Italia per il tramite di una stabile organizzazione, ovvero con la nomina di un rappresentante fiscale o mediante identificazione diretta. Tale interpretazione, precisano le Entrate con il Principio di diritto n. 24 del 19 novembre 2019, si è resa necessaria "al fine di evitare ogni profilo di incompatibilità della disciplina dell'IVA di gruppo con il diritto comunitario", con particolare riguardo alle norme del trattato sulla libertà di stabilimento che vieta discriminazioni a carico di soggetti comunitari non residenti nel Paese di destinazione della prestazione. Dunque, conclude l'Agenzia, la medesima tutela non si estende ai soggetti residenti in Paesi extra UE che, pertanto, non possono accedere alla liquidazione IVA di gruppo.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
