LO SAPEVI CHE POTREBBE ARRIVARE LA PEC OBBLIGATORIA PER GLI AUTOMOBILISTI?


Il proprietario del veicolo dovrà comunicare il proprio indirizzo di posta elettronica certificata (PEC) anche per ricevere le comunicazioni relative alle infrazioni commesse. Il CNEL ha presentato, il 25 settembre 2019, tre disegni di legge (DDL Camera 31, 32, 33) per modificare il Codice della Strada, col dichiarato obiettivo di migliorare la sicurezza stradale e contrastare l'aumento degli incidenti. Il primo DdL n. 31, rubricato "Modifiche alla legislazione vigente sulla pianificazione, l'attuazione e il monitoraggio degli interventi in materia di sicurezza stradale. Costituzione della Consulta nazionale per la sicurezza stradale e per la mobilità sostenibile", è finalizzato a rafforzare la capacità di governo in tema di sicurezza stradale, prevedendo il rilancio di uno specifico organismo, la "Consulta nazionale per la sicurezza stradale" già esistente presso il CNEL dal 2001, con compiti di consultazione pubblica, proposta, i promozione di iniziative a sostegno della sicurezza e dello sviluppo sostenibile della mobilità, valutazione degli esiti del monitoraggio, come pure delle risultanze del conto Nazionale delle Infrastrutture e dei Trasporti in materia di domanda di mobilità. Il secondo DdL n. 32, rubricato "Interventi di modifica al codice della strada per il rafforzamento della effettività delle prescrizioni. Protezione degli utenti vulnerabili. Controllo diffuso. Semplificazione e contenimento della spesa", si propone - oltre ad una intensificazione delle sanzioni amministrative accessorie e penali all'accertamento di reati, previste dall'art. 222 del Codice della Strada - di modificare il testo dell'art. 80 del Codice della Strada, statuendo, all'atto dell'immatricolazione dei veicoli, ovvero della revisione periodica degli stessi, l'obbligo per il proprietario di comunicare il proprio indirizzo di posta elettronica certificata (PEC) per le notificazioni delle violazioni previste dall'articolo 201 dello stesso C.d.S., in linea con le disposizioni già contenute nel decreto interministeriale 18 dicembre 2017, recante la "Disciplina delle procedure per la notificazione dei verbali di accertamento delle violazioni del codice della strada, tramite posta elettronica certificata". Il terzo DdL n. 33, infine, riguarda le "Modifiche al codice della strada in materia di sicurezza del lavoro e per il sostegno al lavoro meccanizzato in agricoltura", estendendo le revisioni previste dai veicoli e disciplinate dall'art. 80 C.d.S. sia alle macchine agricole che a quelle operatrici. L'art. 105 C.d.S., sul traino di macchine agricole, viene emendato nella finalità di adeguare l'ordinamento alla mutata esigenza delle macchine agricole che circolano su strada per le necessità produttive del settore, stabilendo inoltre che l'eventuale scavalcamento dei limiti circoscritti all'art 105, raffigura un convoglio agricolo eccezionale.
