LA CASSAZIONE BOCCIA IL TRANSFER PRICE DOMESTICO


Con la sentenza n. 16948, depositata il 25 giugno 2019, la Corte di Cassazione ha ribadito che l'istituto del transfer price non si applica alle operazioni compiute da parte di società entro i confini nazionali. Dopo aver richiamato i differenti orientamenti in merito alla configurabilità dell'istituto, la sentenza chiarisce che la valutazione dello scostamento del valore dell'operazione da quello normale (art. 9 TUIR), che prescinde dalla capacità di produrre reddito e da qualsiasi obbligo negoziale, non può fondare alcuna analisi di elusività della transazione per le operazioni tra società appartenenti al medesimo gruppo nazionale. In via del tutto residuale, la suddetta discrepanza potrà solo essere considerata alla stregua di un mero indizio per la verifica dell'antieconomicità dell'operazione. L'esclusione dell'applicazione dell'istituto in esame è stata confermata anche dal D.Lgs. n. 147/2015. Il caso in esame si riferiva ad una operazione eseguita tra società dello stesso gruppo, sul territorio nazionale, e rispondeva ad una strategia economica diretta a raggiungere un risultato nell'interesse di tutte le società del gruppo.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
