Cedolare secca con applicazione dell'aliquota del 10% anche per contratti di locazione abitativa di tipo transitorio


L'art. 3, comma 2, del D.lgs. 14 marzo 2011, n. 23 prevede che si possa applicare l'aliquota IVA ridotta alla cedolare secca esclusivamente per i contratti di locazione che risultino: riferiti a unità immobiliari ubicate nei comuni con carenze di disponibilità abitative individuati dall'articolo 1, c. 1, lettere a) e b), del DL 551/1988 (Bari, Bologna, Catania, Firenze, Genova, Milano, Napoli, Palermo, Roma, Torino e Venezia, nonché i comuni confinanti con gli stessi e gli altri comuni capoluogo di provincia) e negli altri comuni ad alta tensione abitativa individuati dal CIPE stipulati a canone concordato sulla base di appositi accordi tra le organizzazioni della proprietà edilizia e degli inquilini, di cui agli articoli 2, c. 3, e 8 della L. 431/1998. In particolare il citato art. 2, c. 3, della legge n. 431/1998 ammette che le parti possano stabilire la durata del contratto "anche in relazione a quanto previsto dall'articolo 5, comma 1", ossia in ossequio ad esigenze abitative di tipo transitorio diverse da quelle degli studenti universitari, previste dal successivo comma 2 del medesimo art. 5. Tenuto conto del tenore letterale di tale disposizione, l'Agenzia Entrate nella circolare 8/E del 7 aprile 2017, ha precisato che l'aliquota ridotta IVA è da ritenersi applicabile anche ai contratti transitori di cui all'art. 5, comma 1, della L. 431/1998 (ossia ai contratti di durata da un minimo di un mese ad un massimo di 18 mesi), a condizione che, come nel caso prospettato, si tratti di un contratto di locazione a canone concordato relativo ad abitazioni ubicate nei comuni con carenze di disponibilità abitative o in quelli ad alta tensione abitativa.

  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
