Detrazione dei costi di recupero del patrimonio edilizio sostenuti dal convivente possibile a partire dal 1° gennaio 2016


Con la Risoluzione n. 64/E del 28 luglio 2016 l'Agenzia Entrate ha riconosciuto la possibilità di fruire della detrazione dei costi di recupero del patrimonio edilizio sostenuti dal convivente anche nel caso in cui non fosse possessore o detentore dell'immobile oggetto dei lavori, similmente a quanto previsto per i familiari conviventi (chiarimento valido anche per le detrazioni sul risparmio energetico e l'acquisto di mobili ed elettrodomestici). Questo, richiamando la legge 20 maggio 2016, n. 76, che estende alcuni diritti spettanti ai coniugi anche ai conviventi di fatto. Con la circolare n. 8 del 7 aprile 2017, l'Agenzia Entrate precisa che tale orientamento si può ritenere applicabile alle sole spese sostenute a partire dal 1° gennaio 2016, poiché era stato espresso tenendo conto dell'emanazione della legge n. 76/2016 (entrata in vigore il 5 giugno 2016) e del principio di unitarietà del periodo d'imposta.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
