Fatturazione elettronica: L'A.E. sulle deleghe non è puntuale e regna il caos


Il provvedimento 291241/2018 del 5 novembre 2018 indica che per i soggetti privi di dati iva del 2016 la delega viene trasmessa dall'intermediario con predisposizione di un file, contenenete un prospetto - copia della delega - copia di documento di identità del delegante, con firma digitale del file e trasmissione del medesimo ad un indirizzo pec dell'agenzia. Il punto 5 del provvedimento in questione recita che "le deleghe presentate con le modalità di cui al punto 4.8 (nota: quello dell'invio tramite PEC) sono attivate entro 5 giorni lavorativi dalla data di .....invio tramite PEC della richiesta". Ho inviato tali richieste con messaggio PEC del 10/12/2018 e, ad oggi, scaduti i 5 giorni lavorativi, non ho ricevuto alcuna risposta, ciò a dimostrare ormai il caos che si è venuto a creare; non solo ma in occasione di operazioni straordinarie (donazioni d'azienda con effetto dal 1° gennaio 2019, conferimenti dal 1° gennaio 2019) risulterà impossibile predisporre la delega e recepirla da parte dell'agenzia delle entrate. Per la fatturazione elettronica la generalità dei contribuenti non era e non è preparata, ma sembra neppure l'agenzia delle entrate.

The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
