Nuova soglia dei 500 euro per le ritenute applicate dai condomini


La legge 11 dicembre 2016, n. 232 (legge di Bilancio 2017) ha modificato la disciplina dei versamenti delle ritenute Irpef operate dal condominio quale di sostituto d'imposta nei confronti dell'appaltatore. In particolare ha stabilito che le ritenute operate dai condomini vanno versate quando raggiungono la soglia di 500 euro; in caso contrario, i termini di versamento sono il 30 giugno e il 20 dicembre di ogni anno. La nuova norma è entrata in vigore il 1° gennaio 2017. L'Agenzia Entrate, con la sua circolare n. 8 del 7 aprile 2017, ha precisato che la nuova disciplina esplica effetti anche per le ritenute applicate nel mese di dicembre 2016; dunque, per le stesse il termine di versamento sarebbe stato il 16 gennaio 2017 solo in caso di superamento della soglia dei 500 euro. Nella stessa circolare 8/2017 l'Agenzia Entrate ha chiarito le modalità di calcolo della soglia dei 500 euro precisando che va calcolata sommando le ritenute operate mese dopo mese. A titolo di esempio, se in febbraio vengono applicate ritenute per 400 euro e a marzo ritenute per ulteriori 400 euro, la somma (800 euro) dovrà essere versata entro il giorno 16 del mese successivo a quello in cui viene superata la soglia, in questo caso il 16 aprile. Il condominio potrà comunque scegliere di continuare a versare le ritenute entro il giorno 16 del mese successivo a quello in cui le ha operate, anche se complessivamente inferiori a 500 euro. Non incorrerà in nessuna sanzione poiché il suo comportamento non arreca danni all'erario e la banca intermediaria non può legittimamente rifiutare il pagamento delle ritenute.
