DURC ONLINE - STIPULATA UNA CONVENZIONE TRA INAIL, INPS E MINISTERO DELLO SVILUPPO ECONOMICO


E' stata sottoscritta, il 31 ottobre 2018, tra l'Istituto Nazionale per l'Assicurazione contro gli Infortuni sul Lavoro (INAIL), 'Istituto Nazionale della Previdenza Sociale (INPS) e il Ministero dello sviluppo economico. D'intesa con la Commissione Nazionale Paritetica per le Casse Edili (CNCE); una convenzione, di durata triennale, per regolamentare i rapporti tra le parti, sulla modalità di fornitura dei dati per la verifica della regolarità contributiva, in attuazione di quanto previsto dalla vigente normativa in materia ed in conformità ai principi stabiliti dal Codice e dagli standard di sicurezza informatica. Le Parti sono autorizzate ad accedere ai dati suddetti nel rispetto e nei limiti delle finalità istituzionali perseguite e della base normativa che le legittima per l'acquisizione delle informazioni individuate in premessa. Le Parti accedono reciprocamente ai dati previsti in convenzione attraverso le modalità e le misure di sicurezza riportate nell'allegato 4. Le modalità di adesione all'accordo quadro saranno pubblicate sui siti istituzionali di INPS ed INAIL. L'accordo prevede che ogni Parte nomini un proprio Responsabile della Convenzione e un proprio Referente tecnico, per la gestione dei rapporti e trattamento dei dati tra le Parti, nel rispetto delle norme vigenti sulla privacy. L'intesa disciplina poi le modalità operative di adesione ai servizi del DURC online fornito dall'INPS, con l'obiettivo di integrare il sistema con le applicazioni della Pubblica Amministrazione, automatizzando le attività di richiesta di regolarità e la gestione degli esiti della verifica. In particolare, la comunicazione tramite DURC online avviene tramite due metodi: il metodo sendDurcRequest, col quale il richiedente invia la richiesta; il metodo sendDurcResponse, col quale l'INPS invia l'esito delle verifiche di regolarità per ciascun codice fiscale nella richiesta. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
