MOGLIE O NO, LA NOTIFICA è "FATTA" SE CHI APRE LA PORTA ACCETTA L'ATTO


La presenza in casa e la disponibilità a ricevere il plico comporta la ragionevole presunzione che il consegnatario porterà sollecitamente la cartella nelle mani del diretto interessato. La qualità di persona abilitata alla ricezione dell'atto presso il domicilio del destinatario si presume dalle dichiarazioni recepite dall'ufficiale notificatore nella relata di notifica, salvo che l'interessato fornisca la prova contraria, dimostrando l'inesistenza di un rapporto con il consegnatario comportante la qualità dichiarata ovvero l'occasionalità della presenza di questi presso il domicilio. È il principio ribadito nella sentenza n. 27587 del 30 ottobre 2018, in cui la Corte, in mancanza della suddetta prova, ha affermato la validità della notifica eseguita presso il domicilio del destinatario a persona che si era qualificata moglie dello stesso, senza in realtà essere tale. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
