RACCOLTA DELLE IMPRONTE DIGITALI DEI DIPENDENTI: SERVE L'AUTORIZZAZIONE DEL GARANTE


Per la raccolta delle impronte digitali dei dipendenti per rilevare le presenze: serve l'autorizzazione da parte del Garante per la protezione dei dati personali. La Corte di Cassazione, Sezione II, con sentenza n. 25686 del 15 ottobre 2018, ha confermato la legittimità dell'ingiunzione con cui nel 2012 l'Autorità Garante aveva intimato ad una Società, che ha installato un sistema di raccolta delle impronte digitali dei propri dipendenti, di pagare una sanzione per l'omissione degli adempimenti prescritti dal Codice Privacy quando quest'ultima affermava, invece, di non aver effettuato nessun trattamento sui dati personali. Per la Corte ciò che rileva è che attraverso la conservazione dell'algoritmo, si può risalire al dipendente e quindi identificarlo. Per l'installazione di un sistema di raccolta dei dati biometrici era inoltre necessario l'ottenimento dell'autorizzazione da parte del Garante ai sensi dell'art. 37 del Codice Privacy, circostanza non soddisfatta dalla Società. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
