ANCHE PER LE PUBBLICAZIONI ELETTRONICHE L'ALIQUOTA IVA AL 4%


Sulla Gazzetta Ufficiale dell'Unione Europea è stat pubblicata la Direttiva (UE) 2018/1713 del 6 novembre 2018 che, andando a modificare la direttiva 2006/112/CE, consente agli Stati membri di applicare le stesse aliquote IVA alle pubblicazioni fornite per via elettronica che attualmente applicano alle pubblicazioni su supporti fisici. La direttiva 2006/112/CE del Consiglio stabiliva, infatti, che gli Stati membri potessero applicare aliquote Iva ridotte alle pubblicazioni su supporti fisici ma non alle pubblicazioni fornite per via elettronica, che dovevano essere assoggettate all'aliquota IVA normale. Con Comunicazione del 7 aprile 2016 la Commissione ha invece evidenziato come le pubblicazioni fornite per via elettronica dovessero poter beneficiare dello stesso trattamento preferenziale, in termini di aliquota IVA, delle pubblicazioni fornite su supporti fisici. Queste, in particolare, le modifiche apportate alla direttiva 2006/112/CE: all'articolo 98, paragrafo 2, il secondo comma è sostituito dal seguente: "Le aliquote ridotte non si applicano ai servizi forniti per via elettronica, a eccezione di quelli che rientrano nell'al­ legato III, punto 6)."; all'articolo 99 è aggiunto il seguente paragrafo: "3. In deroga ai paragrafi 1 e 2 del presente articolo e in aggiunta alle aliquote di cui all'articolo 98, paragrafo 1, gli Stati membri che al 1o gennaio 2017 applicavano, in conformità del diritto dell'Unione, aliquote ridotte inferiori al minimo prescritto nel presente articolo o accordavano esenzioni con diritto a detrazione dell'IVA pagata nella fase precedente alla fornitura di taluni beni di cui all'allegato III, punto 6), possono altresì applicare il medesimo trattamento ai fini dell'IVA qualora tali beni siano forniti per via elettronica, conformemente all'allegato III, punto 6)."; nell'allegato III, il punto 6) è sostituito dal seguente: "6) fornitura di libri, giornali e periodici, inclusi quelli in locazione nelle biblioteche forniti su supporti fisici o per via elettronica o in entrambi i formati (compresi gli opuscoli, i volantini e gli stampati analoghi, gli album, gli album da disegno o da colorare per bambini, la musica stampata o manoscritta, le mappe e le carte idrografiche o altri tipi di carte), escluse le pubblicazioni interamente o essenzialmente destinate alla pubblicità ed escluse le pubblicazioni consistenti interamente o essenzialmente in contenuto video o audio musicale;".   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
