DETASSAZIONE PREMI DI RISULTATO: SE NON C'è INCREMENTO DI PRODUTTIVITà ADDIO AGEVOLAZIONI


L'Agenzia delle Entrate, con la Risoluzione n. 78/E si è espressa in tema di Reddito di lavoro dipendente - Detassazione Premi di risultato. In particolare, alle Entrate è stato chiesto se, una volta raggiunto l'obiettivo ed essendo stati rispettati i presupposti richiesti dal legislatore per l'applicazione del regime agevolato previsto dall'art. 1, commi 182 e ss. della legge di Stabilità 2016, sia corretta l'applicazione del beneficio fiscale attraverso la detassazione del premio di risultato erogato ai propri dipendenti. Come noto, il citato articolo della legge di Stabilità 2016 ha previsto misure fiscali agevolative per le retribuzioni premiali introducendo una modalità di tassazione agevolata consistente nell'applicazione di un'imposta sostitutiva dell'IRPEF e delle relative addizionali del 10 per cento ai "premi di risultato di ammontare variabile, la cui corresponsione sia legata ad incrementi di produttività, redditività, qualità, efficienza ed innovazione, misurabili e verificabili sulla base dei criteri definiti con il decreto di cui al comma 188". Le Entrate, nella Risoluzione in esame, hanno chiarito che il requisito dell'incrementalità, che si rileva dal confronto tra il valore dell'obiettivo registrato all'inizio del periodo congruo e quello risultante al termine dello stesso, costituisce il presupposto per l'applicazione del regime agevolato. Non è quindi sufficiente che l'obiettivo prefissato dalla contrattazione di secondo livello sia raggiunto, in quanto è necessario che il risultato conseguito dall'azienda risulti incrementale rispetto al risultato antecedente l'inizio del periodo di maturazione del premio.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
