MINISTERO DEL LAVORO: CHIARIMENTI IN TEMA DI SOGGETTI FORMATORI PER CORSI IN MODALITà E-LEARNING


La Commissione per gli interpelli in materia di salute e sicurezza sul lavoro del Ministero del Lavoro e delle Politiche Sociali, con l'Interpello n. 7/ 2018 si è espressa in tema di soggetti formatori per corsi per lavoratori in modalità e-learning. In particolare l'interpellante (Consiglio Nazionale delle Ricerche) ha chiesto il parere della Commissione in merito all'applicazione delle disposizioni dell'Allegato II dell'Accordo in sede di Conferenza Permanente per i rapporti tra lo Stato, le Regioni e le Province Autonome di Trento e di Bolzano del 7 luglio del 2016 "esclusivamente ai soggetti formatori per Rspp e Aspp (ex art. 32 del D.Lgs 81/08), non estendendo tale obbligo anche ai datori di lavoro che organizzano corsi in modalità E - learning per i propri lavoratori secondo le modalità e i criteri previsti dall'accordo...". Al riguardo, precisa la Commissione, occorre considerare che l'Accordo in sede di Conferenza Permanente per i rapporti tra lo Stato, le Regioni e le Province Autonome di Trento e di Bolzano del 7 luglio 2016, nella parte titolata "durata e contenuti minimi dei percorsi formativi per responsabili e addetti dei servizi di prevenzione e protezione", in punto di premessa, ravvisa esplicitamente "la necessità di procedere alla sostituzione dell'Allegato I all'Accordo del 21 dicembre 2011 per la formazione dei lavoratori, ai sensi dell'articolo 37, comma 2, del d.lgs. n. 81/2008, con l'allegato II al presente Accordo, relativo alla formazione in modalità e-learning, al fine di superare le incertezze applicative in tema di formazione emerse in sede di prima applicazione della pertinente disciplina". Pertanto, sulla base di quanto stabilito nel citato Accordo, i soggetti formatori sono solo quelli individuati al punto 2 dell'allegato A (individuazione dei soggetti formatori e sistema di accreditamento) e che, pertanto, soltanto questi soggetti possano erogare la formazione in modalità e-learning, nel rispetto delle disposizioni contenute nell'Allegato II.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
