I CASI DI ESONERO DALL'OBBLIGO DI TRASMISSIONE DELLE FATTURE (C.D. NUOVO SPESOMETRO)


L'Agenzia Entrate nella circolare n. 8/E del 7 aprile 2017 ha fornito alcuni chiarimenti sugli esoneri dalla trasmissione dei dati delle fatture. L'art. 21 c.1 del D.L. 78/2010, nella versione attualmente in vigore, ha previsto come unico caso di esclusione dall'obbligo di trasmissione dei dati delle fatture quello relativo ai produttori agricoli nelle zone montane. Di conseguenza sono venute meno le cause di esclusione previste dalle precedenti formulazioni della norma. I soggetti passivi IVA saranno tenuti a comunicare i dati di tutte le singole fatture emesse e ricevute, incluse le bollette doganali, a prescindere dall'importo. Tuttavia l'Agenzia ha precisato che l'invio dei dati ha lo scopo di controllare le operazioni rilevanti ai fini IVA e di prevenire gli illeciti. Dunque, ha stabilito (richiamando la circolare n. 1/2017) che sono esonerati dagli obblighi previsti dell'art. 21 i soggetti che utilizzano il regime forfetario (art. 1, c. 54-89, L. 190/2014) e quelli che hanno utilizzato il regime dei minimi (ex art. 27 c. 1-2, D.L. 98/2011) fino al 2015 e che lo adotteranno fino alla scadenza. Questi ultimi non devono annotare le fatture, non applicano l'IVA ai propri clienti, non si detraggono l'IVA sugli acquisti, non effettuano le liquidazioni periodiche e non devono versare l'imposta, né sono tenuti alla presentazione della dichiarazione IVA. La circolare n. 1/2017 ha stabilito, inoltre, che anche le Amministrazioni pubbliche non devono comunicare le fatture ricevute perché essi sono già soggette all'obbligo di inviare le fatture attraverso il Sistema di Interscambio previsto dall'art. 1 L. 244/2007. Tuttavia anch'esse sono tenute all'invio dei dati delle fatture e delle note di variazione emesse nei confronti di soggetti diversi dalle pubbliche amministrazioni, non trasmesse con il Sistema di Interscambio.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
