Famiglia di fatto: diritto di visita anche ai nonni acquisiti


Anche ai nonni acquisiti va riconosciuto il diritto di visita dei nipoti.La Cassazione ha sancito un importante principio in materia di famiglia di fatto, ossia che il diritto di ad avere rapporti significativi con i nipoti va riconosciuto non solo a chi ha un rapporto di parentela diretta, ma anche "a ogni altra persona che affianchi il nonno biologico del minore, sia esso il coniuge o il convivente di fatto" (Cassazione, sentenza del 25 luglio 2018, n. 19779). L'importante è che quest'ultimo si sia dimostrato adatto ad instaurare con il minore una relazione affettiva stabile, che possa garantire allo stesso un beneficio. Il caso In particolare, la Cassazione era stata chiamata ad esaminare il ricorso di una nonna "acquisita" (compagna di fatto del nonno biologico del minore), alla quale i giudici di merito avevano negato la tutela in merito al rapporto con il nipote, ritenendo che la stessa non fosse "legittimata ad agire". La Cassazione, ribaltando l'orientamento dei giudici di merito, ha invece valorizzato il rapporto di fatto che si era instaurato tra la ricorrente e il nonno biologico del minore, tale da configurare una famiglia di fatto. Come far valere il diritto di visita Ma come possono i nonni, siano essi acquisiti o biologici, far valere il proprio diritto di visita? Sul punto la giurisprudenza, già da tempo riconosce ai nonni la possibilità di agire ex articolo 336 del Codice civile, non potendo invece intervenire nel giudizio di separazione per regolare il loro diritto di visita con i nipoti. In tal senso si è espressa la Corte di Cassazione con la sentenza del 27 dicembre 2011, n. 28902 in ragione del fatto che la legge sull'affido condiviso n. 54/2006 non prevede un'azione diretta degli ascendenti e degli altri familiari per regolare le visite con i bambini. In altre parole, afferma l Cassazione, i nonni "non sono titolari di una posizione soggettiva direttamente tutelabile". Dal punto di vista processuale, pertanto, non ricorrono i presupposti per un intervento nel giudizio di separazione da parte dei nonni, ai sensi dell'articolo 105 del Codice di procedura civile, che richiede la sussistenza di diritti relativi all'oggetto o dipendenti dal titolo dedotto nel processo ovvero un interesse a sostenere le ragioni di una delle parti, idoneo a fondare un intervento ad adiuvandum. D'altra parte, tuttavia, seppure non è ammessa la partecipazione dei nonni nei giudizi di separazione (o divorzio), resta comunque salva la possibilità per gli stessi di agire ex articolo 336 del Codice civile, dinanzi al Tribunale per i minorenni, per far accertare il corretto esercizio della potestà genitoriale. di Antonella Pedone Fonte: https://www.aduc.it
