RIFORMA D.LGS. 231/2001: 'MESSA ALLA PROVA' PER SANARE LE CARENZE DEL MOG ED ESTINGUERE L'ILLECITO


Il nuovo disegno di legge per la revisione del D.Lgs. 231/2001, varato in prima lettura dal Consiglio dei Ministri lo scorso 4 agosto 2026, introduce una procedura di riparazione assimilabile alla "messa alla prova" (già prevista per le persone fisiche). La norma offrirà alle società la possibilità di rimediare all'inefficacia del proprio Modello Organizzativo e di Gestione (MOG), arrivando fino all'estinzione dell'illecito. Entro 90 giorni dalla notifica dell'avviso di conclusione delle indagini preliminari, la società potrà richiedere al GIP un termine per adeguare il modello, presentando un piano d'azione dettagliato che includa le proposte di adeguamento, le condotte riparatorie e l'impegno a mettere a disposizione il profitto illecito. Il GIP, valutata l'idoneità del piano anche tramite perito e fissata una cauzione, sospenderà il procedimento. In caso di esito positivo delle verifiche finali, il giudice dichiarerà l'estinzione dell'illecito, disponendo la sola confisca del profitto; in caso di inadempimento, la sospensione verrà revocata e il procedimento sanzionatorio riprenderà il suo corso.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
