ANTIRICICLAGGIO: ISTRUZIONI UIF IN VIGORE DAL 1° LUGLIO 2026


Con un provvedimento 18/12/2025, in vigore dal 1° luglio 2026, la UIF emana istruzioni in materia di segnalazioni di operazioni sospette (SOS), le quali sono garantite dalla riservatezza e dall?"anonimato. Il documento sottolinea il principio di collaborazione attiva tra i soggetti alla normativa e la UIF, andando ad analizzare l?"individuazione delle anomalie e sottolineando comunque i principi di proporzionalità (Indicatori di anomalie di cui al Provvedimento UIF 12/05/2023). Viene quindi sottolineato quanto la valutazione del rischio e l?"utilizzo di strumenti informatici basati su regole e parametri sia funzionale all?"individuazione delle operatività anomale: infatti, l?"inoltrare una SOS è comunque un giudizio, a seguito di un?"attenta valutazione, che fa maturare  al professionista, il quale ha il “sospetto” appunto che l?"operazione sia da ritenersi sospetta; a pagina 10 del documento vengono elencati elementi che di per sé non vengono reputati sufficienti per effettuare la SOS.  Viene inoltre sottolineata l'importanza della valutazione del rischio nell'individuazione delle operazioni sospette. Il documento evidenzia che l'impiego di strumenti informatici basati su regole e parametri rappresenta un valido supporto per intercettare possibili anomalie, ma non può sostituire il giudizio del professionista. La decisione di trasmettere una segnalazione di operazione sospetta (SOS), infatti, deve essere il risultato di una valutazione complessiva delle circostanze che porti a ritenere sussistente un fondato sospetto. A pagina 10 del provvedimento, inoltre, sono indicati alcuni elementi che, se considerati isolatamente, non sono ritenuti sufficienti a giustificare l'invio di una SOS. La sezione VII del documento tratta della sospensione delle SOS, mentre la IX della SOS e della sospensione. La parte seconda tratta del referente SOS, della procedura interna delle SOS.

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
